The latest revisions to Texas Senate Bill 3 (SB3) are a glaring example of what happens when cannabis legislation is written without industry expertise at the table.

What’s in the Latest Draft of SB3?

The most recent version of SB3 includes major changes that would drastically reshape the hemp industry in Texas. Here’s what’s in the bill:

  • CBD and CBG Only: SB3 proposes that consumable hemp products may only contain cannabidiol (CBD) or cannabigerol (CBG). This would effectively ban popular and therapeutic cannabinoids like Delta-8 THC, THCa, and Delta-10—despite their legality under federal law.

  • DEA Lab Testing Requirement: All consumable hemp products must be tested by laboratories that are (1) located in Texas, (2) registered with the U.S. Drug Enforcement Administration (DEA), and (3) ISO/IEC 17025 accredited. This limits access to testing labs and increases operational costs for small businesses.

  • Flower Possession and Sales Restrictions: The bill restricts personal possession of hemp flower to one ounce and bans the sale of consumable hemp products within 1,000 feet of schools, churches, and other “sensitive use” locations.

  • No Alcohol or Tobacco Additives: SB3 prohibits any consumable hemp product from containing or being combined with alcohol or tobacco. This includes pre-mixed products or any co-packaged items.

  • Regulatory Oversight Shift: Oversight of consumable hemp products would shift from the Texas Department of State Health Services (DSHS) to the Texas Alcoholic Beverage Commission (TABC), placing hemp products under the same regulatory body that governs alcohol sales.
